CAVLUX ONLINE STORE TERMS AND CONDITIONS

 

§1 General Provisions


1. These Terms and Conditions define the rules for using the online store located at www.cavlux.eu, operated by GoPack Jacek Frydrych, with its registered office in Gołańcz, ul. Sportowa 26L, 62-130 Gołańcz, entered in the Central Register and Information on Economic Activity, Tax Identification Number (NIP): 766 124 62 04 (hereinafter referred to as the Seller).
2. Contact with the Seller is possible via email at sklep@cavlux.eu.
3. These Terms and Conditions define the rules for concluding distance sales agreements between the Seller and the Customer via the online store.
4. The Customer may be a natural person with full legal capacity (hereinafter referred to as the Consumer) or another entity making purchases in the store for purposes not directly related to their business activity.

§2 Definitions

1. Online Store – the online service available at www.cavlux.eu, through which the Customer can place orders.
2. Customer – a natural person making purchases in the online store.
3. Goods – products offered in the store, in particular riding saddlebags and related accessories.
4. Order – the Customer's declaration of intent aimed at concluding a sales contract.
5. Customer Account – an individual account created by the Customer in the store.
6. Business Day – a day from Monday to Friday, excluding public holidays.

§3 Rules of Use of the Store

1. The condition for using the Store is to read and accept these Terms and Conditions.
2. The Store allows placing orders without the need to register an account.
3. All prices listed in the Store are gross prices (including VAT) and are expressed in Polish zloty.
4. The Seller reserves the right to change the prices of goods, but these changes do not affect orders already placed by the Customer. 5. Each product in the store includes information files, such as "Package User's Manual" and "Cover Care Instructions," regarding the proper use and maintenance of the products. Their purpose is to ensure the correct and safe use of the offered goods.

§4 Ordering


1. Orders can be placed via the store's website.
2. After placing the order, the Customer will receive an automatic confirmation of its acceptance to the email address provided during the ordering process.
3. The sales contract is concluded upon confirmation of the order by the Seller.
4. In the case of custom-made (personalized) goods, fulfillment begins after the details are confirmed by the Seller and payment is received.

§5 Payments and Delivery

1. The Customer can pay for the ordered goods in the following ways:

a) Traditional bank transfer – the Customer can make a payment to the following bank account number

The order will be shipped after payment confirmation in the Seller's bank account.


b) Cash payment – payment is possible at the Seller's office after prior arrangement of a pickup date.

 

2. Delivery of goods within the territory of the Republic of Poland is carried out via:

  • DPD courier – delivery of saddle boxes,
  • DPD or InPost courier – delivery of equestrian accessories,
  • personal collection at the company's office is also possible by prior arrangement.

3. Order processing time for saddle boxes:

  • Pony packs – processing time: 2-5 weeks
  • Junior packs – processing time: 2-5 weeks
  • Superior packs – processing time: 2-5 weeks

4. Delivery time for covers: 3 weeks regardless of the model.

5. Delivery time for accessories: up to 1 week, depending on store stock.

6. For personalized or custom-made goods, the delivery time may be extended – the customer will be notified by email.

The rules for preparing shipments, securing them, and handling packages upon delivery are described in Appendix 1 to these Terms and Conditions – “Cavlux Delivery.” The appendix is an integral part of the Terms and Conditions and contains detailed information on quality control, shipment documentation, and the procedure for handling transport damage.

§6 Returns and Complaints

Withdrawal from the Contract (Return of Goods)
1. A Customer who is a Consumer has the right to withdraw from a distance sales contract within 14 days of receiving the product, without giving any reason.

2. To exercise the right of withdrawal, the Customer should submit a declaration of withdrawal electronically to the following email address: info@cavlux.eu or in writing by post to: GoPack, ul. Sportowa 26L, 62-130 Gołańcz.

3. Returned goods must be returned immediately, but no later than 14 days from the date on which the Customer informed the Seller of their withdrawal from the contract.

4. The cost of returning the goods in the event of withdrawal from the contract is borne by the Customer.

5. Only complete, undamaged goods with no signs of use beyond normal inspection are eligible for return.

6. The Seller will refund the payment within 14 days of receiving the withdrawal notice, using the same payment method used by the Customer, unless the Customer agrees to a different refund method that does not involve additional costs.

7. The Seller may withhold the refund until the Customer receives the returned goods or provides proof of shipment, whichever occurs first.

8. The right to withdraw from the contract does not apply to goods made to the Customer's individual order or personalized (e.g., products with an individual marking, such as an engraved logo, rider's name, horse's name, or stable name), in accordance with Article 38 of the Consumer Rights Act.

9. A sample withdrawal form is attached to these Terms and Conditions and is available on the store's website.

Complaints

1. If a defect in the goods covered by the warranty or guarantee is discovered, the Customer is obliged to submit a complaint electronically to the following address: info@cavlux.eu.

2. The complaint should include: the Customer's name and surname or company name, order or invoice number, description of the defect, photos documenting the problem, and the date it was discovered.

3. The Seller will review the complaint within 14 days from the date of its submission.

4. If the complaint is accepted, the Seller will inform the Customer about the next steps, in particular the form of repair, replacement, or other possible solution.

5. If the product needs to be returned as part of the complaint, it should be sent to: GoPack, ul. Sportowa 26L, 62-130 Gołańcz.

6. If the reported defect is not covered by the warranty or guarantee (e.g., mechanical damage resulting from improper use, storage, or transport), the Seller reserves the right to refuse the complaint.

7. In the cases referred to in paragraph 14, the Seller may offer the Customer a paid repair service, provided that such service is possible.

8. As part of a paid service, it is possible to repair consumables such as hinges, locks, fittings, and wheels. To obtain information about service availability and a repair quote, the Customer may contact the Seller at info@cavlux.eu.

9. Warranty and guarantee claims are processed in accordance with the applicable provisions of the Civil Code.

Detailed terms of use of the products and warranty terms are described in the “Certificate” document provided to the Customer together with the purchased goods. This document constitutes an integral part of these Terms and Conditions.

§8 Personal Data

1. The controller of Customers' personal data is GoPack Jacek Frydrych.
2. Personal data is processed for the purpose of fulfilling orders, managing the Customer's account, and communicating with the Customer.
3. Data is processed in accordance with the provisions of the GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council).
4. The Customer has the right to access, correct, restrict processing of their data, and request its deletion.

§9 Final Provisions

1. Agreements concluded through the Online Store are concluded in Polish.

2. The Seller reserves the right to amend the Terms and Conditions for important reasons, including: changes in legal provisions, changes in payment and delivery methods – to the extent such changes affect the implementation of the provisions of these Terms and Conditions. The Seller will inform the Customer of any changes at least 7 days in advance.

3. In matters not regulated by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the Provision of Electronic Services; the Consumer Rights Act; and the Personal Data Protection Act.

4. The Customer has the right to use out-of-court complaint and redress mechanisms. To this end, they may submit a complaint via the EU ODR online platform available at: https://ec.europa.eu/consumers/odr/.

5. The provisions of these Terms and Conditions and the Seller's General Terms and Conditions, as applicable, published on the Seller's website (www.forestagri.pl) and in the Store, shall apply to Sales Agreements.
